Terms and Conditions for the Oktoberfest Madeira Giveaway 2026

1. General

The following terms and conditions apply to participation in the Heartbeat Madeira Oktoberfest Giveaway 2026, organized by MADHEARTBEAT, LDA. By participating in the giveaway, participants accept these terms and conditions.

 

2. Eligibility and Giveaway Mechanics

Participation in the giveaway is free of charge. All persons aged 18 or over are eligible to participate.

To enter the giveaway, participants must either post a photo of our Oktoberfest postcard on their Instagram or Facebook account and tag Heartbeat Madeira in the post.

The post must be published during the giveaway period from September 25, 2026 through October 18, 2026.

Multiple entries are expressly permitted. Each entry that meets the stated participation requirements will count as a separate entry into the giveaway.

The participant's post must be publicly visible at the time of the draw in order for the entry to be considered.

Employees of MADHEARTBEAT, LDA and their relatives, employees and relatives of affiliated companies, as well as employees of agencies involved in organizing the giveaway, are excluded from participation.

 

3. Giveaway Period and Prizes

The giveaway starts on September 25, 2026 and ends on October 18, 2026 at 11:59 PM.

Among all valid entries, three prizes will be awarded.

Each prize consists of 2 places on a Heartbeat Madeira tour.

The prize includes exclusively participation in the respective tour for two people.

The prize does not include, in particular, travel to and from Madeira, flights, transfers, accommodation or hotel stays, meals, insurance, or any other travel or incidental expenses. All costs associated with travel or participation in the tour that are not expressly stated as part of the prize must be covered by the winner.

The specific tour will be selected in consultation with the respective winner and subject to availability.

The prize must be redeemed within one year from the date on which the winner is notified. After this period, the prize expires unless otherwise agreed with the winner.

The winners will be selected at random after the giveaway has ended and will be notified of their prize on October 25, 2026.

Winners will have 3 days from receipt of the notification to confirm acceptance of the prize. If no response is received within this period, the prize may be awarded to another participant.

For the purpose of processing and arranging the prize, winners may be asked to provide the information required for this purpose.

The prize cannot be paid out in cash or transferred to third parties.

 

4. Disqualification

MADHEARTBEAT, LDA reserves the right to exclude individual participants from the giveaway if there are legitimate reasons for doing so, such as providing false information, violating these terms and conditions, manipulating the giveaway, or using unauthorized means.

In particular, entries may be excluded if they violate applicable law or the guidelines of the respective social media platform.

In such cases, prizes may also be revoked and reclaimed after they have already been awarded.

 

5. Data Protection

By participating in the giveaway, the participant agrees that MADHEARTBEAT, LDA may process the personal data collected in connection with participation and, where applicable, in connection with the administration of the prize for the purpose of conducting and administering the giveaway.

Personal data will be used exclusively for conducting and administering the giveaway and for contacting the winners. It will not be disclosed to unauthorized third parties.

After the giveaway has ended and any applicable statutory retention periods have expired, personal data that is no longer required for the administration of the giveaway will be deleted.

Where the applicable legal requirements are met, participants may exercise their rights to access, rectification, erasure, restriction of processing, and data portability.

Participants also have the right to object to the processing of their personal data where the applicable legal requirements are met.

6. Liability

MADHEARTBEAT, LDA assumes no warranty or liability that the giveaway will be available throughout the entire giveaway period or operate without errors.

MADHEARTBEAT, LDA reserves the right to cancel, terminate, modify, or temporarily or permanently suspend the giveaway if this becomes necessary for important reasons.

The tour won as part of the giveaway is subject to availability and the applicable terms, conditions, and safety requirements of Heartbeat Madeira.

7. Miscellaneous

Participation on behalf of another person is not permitted.

Participation in the giveaway is governed by the laws of the Portuguese Republic, insofar as this does not conflict with mandatory statutory provisions. Legal recourse is excluded to the extent permitted by law.

Should any provision of these terms and conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid provision that comes as close as legally permissible to the purpose of the original provision.
